Long Timeline for Nishuane Well, Officials Say

The water project, said one resident at the 3rd Ward community meeting Wednesday, 'will put a stake in the heart of that community' if it is approved.

The council is in an “information gathering phase” with regards to the Nishuane Park water well project in the 4th Ward, officials said during a community meeting this week.  “We need to look at our need for water, our usage of water and what are the concerns people have regarding this pumping station, how do we balance the two and make an informed decision,” Third Ward Councilor Sean Spiller said at a Wednesday night meeting that included Mayor Robert Jackson and Superintendent Penny MacCormack.  The township gets about 80 percent of its water from reservoirs, which Jackson said was “not a healthy number.” For safety and sustainability purposes, Jackson suggested scaling the percent of water the township gets from reservoirs to 50 percent…

Township Receives Transcripts From Nishuane Water Well Hearings

Township Manager Marc Dashield said all questions and comments from residents will be categorized, answered and presented at a future council meeting.

The township has received the transcripts from the two January public hearings about a proposal to construct a water well facility in Nishuane Park.  Township Manager Marc Dashield said at the council meeting on Tuesday the township will now categorize the hundreds of questions and comments voiced by residents at the public hearings. The township will then present and answer all of them during a future council meeting.  “We are going to pull everything in and make a final presentation so we deal with all of the issues before the council ...,” said Dashield. “... We really want to do a thorough job with the issues." He added that more comments will be received that were submitted before the deadline to the Department of Environmental …

Nishuane Park Deed Does Not Preclude Water Well

Montclair will soon receive and address residents' questions/concerns and present them during a council meeting and post them online.

Nishuane Park was given to Montclair more than a 70 years ago as public land, but there are no restriction’s preventing the township from building a proposed water treatment facility on that land, officials said. Township attorney Ira Karasick said on Tuesday there is no language in the parkland’s deed which explicitly restricts the construction of a water treatment facility in Nishuane Park near the intersection of Orange Road and High Street.  “That deed has no language in it -- that I can see -- restricting the use of that property,” said Karasick.  Nishuane Park and Cary’s Woods are divided into six lots and governed by different deeds. While parts of Cary’s Woods, given to the township in 1935, has a condition of being used as a “…

@D-Zone asks "How does the law work? Does the law support the beliefs of residents/taxpayers?" These are philosophical questions. Your comment further above was not philosophical, you wrote that you doubted Ira Karasick's "legal observation". I assume you mean "legal opinion". A deed is a legal document that states some contractual relationship or grants some rights to the use of a property. …   more ›

I find it interesting that the Town puts these documents up on the web one week into a 2 week comment period - NOT before the hearings so that the public could understand the project fully, attend the hearing with that information, and then prepare an informed letter for either the NJDEP Green Acres Division and/or the NJDEP Water Quality Infrastructure Finance Division. Note also that these …   more ›

Residents Reject Water Well Proposed for Nishuane Park

The Montclair Council and mayor said they are still 'evaluating the data' about a plan to build a water treatment facility in the park. And let us know what you think by voting in our Patch poll!

The Montclair Council received an earful of criticism and objections on Tuesday about a township plan to build a water facility in Nishuane Park. For the third time in a week, residents spoke at the public podium and cited both environmental concerns and the loss of parkland as reasons for the council to nix the plan. “This project will once again be diverting land protected by Green Acres,” said resident Audrey Hawley. “There has been no information provided giving a compelling reason for activating this well. "To allow this project to go forward will cause a disturbance to wildlife, plant life and airspace, and change the landscape of the area.”  Township representatives have cited the need to meet future growth, and the well’s long-…

Water Well Unwelcome in Nishuane Park, Residents Say

Montclair homeowners around the park spoke out against the well facility project at the second of two public meetings on Thursday.

A water well proposal in Nishuane Park received a second round of rebuke Thursday night by residents in favor of preserving the parkland.  More than 30 people turned out at the municipal building for a second night to cite their utter disapproval with the township’s Nishuane Well Production Facility Project. The township’s plan, a 38- by 41-foot water treatment facility and 10-foot wide access road from High Street on less than half an acre of the park, is designed to better accommodate Montclair’s growth during the next 30 years. “The sustainability of this supply source is – I don’t want to say infinite – but the projection ... forecasts it is a longtime sustainable source, ” said Andrew Holt, principal of Suburban Consulting Engineers…

Township Wants To Place New Water Well on Protected Parkland

This is the first of two articles about Montclair's proposal to build a water treatment facility in Nishuane Park.

Editor’s note: This is the first of a two part story about the Nishuane Park water well project. Click here to read part two.   The township contends its growth will depend on a larger water supply, but residents object to a plan to place a new water treatment facility on federally protected parkland.   The township is proposing to build a $2.6 million public water facility in a known and viable well on the east side of Nishuane Park near the intersection of High Street and Orange Road. The township says the additional well is necessary to meet both current and future needs in Montclair.  “You have to be proactive before you are reactive,” said Director of Montclair’s Water Bureau Gary Obszarny when it comes toward planning for Montclair…

Nishuane Well Project Gets Backlash from Vocal Residents

This is the second article of two covering the meeting about Nishuane Park well project on Wednesday night.

This is the second part of a two part story about the Nishuane Park water well project. Click here to read part one. The proposed construction of a water well in the 4th Ward is roiling nearby residents who turned out Wednesday to criticize and object to the project.  More than 80 residents crowded into the conference room in the municipal building yesterday to condemn the township's plan to place a water treatment facility on a half acre of protected open space in Nishuane Park.  “It is one of the last vestiges of beautiful parkland left in Montclair ... and all of us use it,” said resident Dr. Jason Slosberg. “We don’t want this to happen. ... I want that park to stay there.” This project is like having “a bridge to no where in …

Nishuane Well Project Meeting Tonight

This will be the first of two public meetings about the proposed well at the park. The second meeting will be on Thursday.

Montclair officials will hold the first of two public meetings tonight, Wednesday, about the Nishuane Park well project.  Starting at 7 p.m. in the municipal building, at 205 Claremont Ave., residents are invited to share their opinions and thoughts about project. Wednesday's meeting will focus on the state-monitored Green Acres designation and the township's request for a minor diversion to construct a pumping facility at the park.  The parkland is restricted by the state's Environmental Protection Green Acres Program. However, the township has submitted a final application for the small diversion of the land to the state's Green Acres Program for approval to construct a building, well, road and workspace for the township's water …
